Cabo Verde: New Industrial Property Code Adopted

Cabo Verde has enacted a new Industrial Property Code under Legislative Decree No. 2/2025, replacing the 2007 framework. The reform aims to modernize the country’s IP system and align it with international standards, including those of the World Intellectual Property Organization (WIPO) and the African Regional Intellectual Property Organization (ARIPO).

The new Code introduces several key changes, including updates to the patent regime in line with international filing systems, recognition of protection for unregistered industrial designs, and, for the first time, protection for plant varieties and traditional knowledge. It also simplifies trademark registration by removing the requirement for graphical representation and strengthens the protection of trade secrets.

Additional measures focus on digitalization and administrative simplification, including the introduction of electronic filing systems aimed at improving access for businesses and innovators. The new Code will enter into force on 2 June 2026.

The reform expands the scope of protection and brings Cabo Verde closer to international IP standards. Businesses operating in or entering the market should review their portfolios, particularly in areas such as designs, plant varieties, and trade secrets, to ensure adequate protection under the new framework.
