The Tunisian law enforcement’s ability to combat the importation and the sale of counterfeit goods that violate intellectual property rights was recently strengthened following the amendment of Articles 51 and 52 of Trademark Law no. 36 of 2001. Law no. 50 of 2007 amending the said Articles was  published in the Official Journal on July 27, 2007 and became effective in the country as of its date of publication.

Specifically, Law no. 50 of 2007 is designed to strengthen the Tunisian Trademark Law in matters related to counterfeit products by:

(1) Promoting tougher standards for the protection of intellectual property rights and enhancing criminal-enforcement efforts.
(2) Imposing deterrent penalties on violators including monetary fines ranging between 5,000 to 50,000 Tunisian Dinars (around US$ 3,900 to US$ 39,000) as well as imprisonment terms of 1 to 6 months.
(3) Indicting those who try to thwart the work of the judicial officers.
